Probation Overview

Business and Professions (B&P) Code section 2228 is the authority for the Medical Board of California (Board) to discipline a licensee by placing him or her on probation. The Board may, as a result of an Accusation filed against a physician and surgeon certificate, order the physician and surgeon on probation for a specified time period with specified terms and conditions.

The Board established a Probation Unit in 1992. Currently, the Probation Unit is comprised of Inspectors that are non-sworn staff whose mandate is to protect the public by ensuring physicians and surgeons who have been placed on probation comply with the imposed terms and conditions. This includes physicians and surgeons who reside and/or practice in California or reside and/or practice in another state. If the probationer does not comply with the imposed terms and conditions, the Board shall proceed with an appropriate enforcement action.
