Congratulations to all those who recently matched into a residency program in California! The Board is here to assist with your questions and licensing needs.

Those who matched into a residency in California and have not yet obtained enough training credits to qualify for a Physician's and Surgeon's License will need to obtain a postgraduate training license (PTL) within 180 days of beginning their training program. Please visit the Board's website for information on applying for your PTL. We encourage you to do so as soon as possible!

In this issue of the newsletter, the Board also reminds physicians of licensing and renewal requirements, requirements for electronic submission of documents by medical schools, mandatory reporting requirements, rules for medical assistants, and other updates from the Board's units.

April was World Autism Month and at the February/March 2024 Board Meeting, the Board members heard a presentation from Dr. Alice Kuo, M.D., Ph.D., called "Rethinking Autism: Identity, not Disease." In this presentation, Dr. Kuo discussed autism as more than a disease and provided information on the available resources.

President's Message

It is an honor and privilege to serve California's consumers as the President of the Board. Each day, our dedicated Board Members and staff work to help ensure that the residents of this state have access to high quality care.

During my time as a Board member, and while President, I've worked to promote mutual respect between the Board and all those who advocate before the Board for themselves and others. If we work together, we can accomplish much.

Earlier this year, I was invited to participate as a guest observer on the California Pregnancy-Associated Mortality Review Committee. Their mission is to eliminate preventable pregnancy-related deaths and associated health inequities. At the Board's May 23-24, 2024, Board meeting, I shared what I am learning from this experience.

As mentioned during our February 29-March 1 Board meeting, I am creating a task force of Board members who will conduct a public process to review and take input from the public and other stakeholders regarding the current questions about potential practice impairment or limitations asked on the Board's initial application for a physician and surgeon license and postgraduate training license. This will be an important opportunity for the Board to learn more about how other state medical boards handle this topic and consider changes to our application questions.

Those are just a couple of the key projects that the Board is working on this year. To keep up on these and other matters, I encourage you to subscribe to receive updates about the Board's public meetings, proposed regulation changes, and other important updates about our activities.

Additionally, we recently said goodbye to two Board members, Mr. Ryan Brooks and Mr. David Lee, and welcomed two new Board members. We are fortunate to have on the Board Dr. Hemant Dhingra, MD, who joined in February 2024 and Dr. Felix Yip, MD, who rejoined the Board last December. I look forward to their contributions.

Finally, I was saddened to learn that our former Board member and Vice-President, Dr. Ronald Lewis, MD, passed away. I will remember his years of service to the Board with appreciation and I recognize how important his voice was in our collective efforts to further the Board's mission to protect consumers. He will be missed.

Mandatory Reporting Requirements: Reporting to the Board

There are California Business & Professions Code sections that require physicians and surgeons, and certain allied health professionals licensed in California to file specific reports with the Board under certain conditions. Below is a summary of those required reports.

All Licensees

Any of the above changes must be submitted within 30 days of the change through the BreEZe webpage.

Physicians

Licensed Midwives

Reports Required by Others

Reporting To Other Entities

  • Live births must be registered with the local registrar of births and deaths for the district in which the birth occurred within 21 days following the date of the event.
  • Medical and health section data and the time of death shall be completed and attested to by the physician last in attendance, or, in some cases, by a licensed physician assistant. Physicians or licensed physician assistants in certain cases will state conditions contributing to death (except in cases to be investigated by the coroner) and the hour and day the death occurred on a certificate of death and indicate the existence of cancer.
  • Certificates of fetal death must be completed by the physician, if any in attendance, within 15 hours after the delivery.
  • Diseases reportable by physicians, physician assistants, nurses, midwives and others in California.
  • Reportable to the local health officer for jurisdiction where patient resides.
  • Injuries by deadly weapon or criminal act.
  • Child Abuse (PC sections 11165.7(a)(21), 11165.9, 11166(a)(c)): Reportable to local law enforcement, county probation department or county welfare department.
  • Adult and Elder Abuse (Welfare and Institutions Code §15630): Reportable to local law enforcement or an adult protective service agency.
  • Injuries Resulting from Neglect or Abuse (PC section 11161.8): Reportable to local law enforcement and the county health department.
  • Lapses of Consciousness (HSC section 103900): Reportable to local health officer.
  • Pesticide Poisoning and Illness (HSC section 105200): Physicians must report pesticide illnesses to the local health officer by telephone within 24 hours.

License Application Processing Timeframes Posted on Board Website

The Board's Licensing Application Processing Times webpage provides public access to the Board's processing timeframes for the Physician's and Surgeon's (P&S) License application, the Postgraduate Training License (PTL) application, and the Transition from a PTL to a P&S License application.

These timeframes (based on calendar days) are updated weekly to reflect the most accurate processing times. Processing time is measured from the date both the application AND required fees are received, to the date of the initial application review.

Processing times can increase or decrease depending on the volume of applications received. Despite the posted timeframes, the Board encourages applicants to apply at least six months prior to when their license is needed.

Please note: Expedited applications are excluded from the posted timeframes. For more information on the requirements for application expedite, see the Priority Review and Expedited Application Process webpage.

A Reminder About the Appropriate Role for Medical Assistants

The Board frequently receives questions about the role of medical assistants (MA) in a medical practice and what types of services an MA can perform. Ultimately, the responsibility for the appropriate use of unlicensed persons in health care delivery rests with the physician.

With training, authorization, and appropriate supervision, these unlicensed professionals may perform a variety of non-invasive, routine, technical supportive services under the supervision of a licensed physician and surgeon, podiatrist, physician assistant, nurse practitioner, or certified nurse-midwife. The MA's supervisor must be physically on the premises of the treatment facility where the MA is performing their services. MAs may not be employed by a licensed general acute care hospital for inpatient care.

To perform the services described below, and other technical supportive services, the MA must be at least 18 years old and obtain a certificate from a training institution or directly from a licensed physician or other authorized medical professional as indicated under Title 16 of the California Code of Regulations section 1366.3(a)(1).

These authorized services include (not all inclusive):

  • administering some medications (but not by IV) with verification of medication and dosage by supervisor
  • collect and record patient vital signs such as temperature, blood pressure, pulse, height and weight; perform limited tests
  • remove sutures or staples from superficial incisions or lacerations
  • apply and remove bandages and dressings to superficial incisions or lacerations
  • apply orthopedic appliances such knee immobilizers, envelope slings, orthotics
  • remove casts splints and other external devices
  • swab the throat
  • administer flu shots, allergy shots, and other vaccines, and narcotic injections except anesthetic agents
  • draw blood for tests

Regardless of their training, MAs are not allowed to perform or assist with the following services (not all inclusive):

  • Determine that a test is required
  • Make a diagnosis
  • Interpret results of skin tests, lab tests, etc.
  • Perform invasive procedures or tests not authorized by statute or regulation

CURES Data Submission Modification

Department of Justice, Justice and Investigative Services Bureau

Beginning August 1, 2024, dispensers will be required to report dispensations to the Controlled Substance Utilization Review and Evaluation System (CURES) using version 4.2B of the American Society for Automation in Pharmacy (ASAP) format.

Currently, California dispensation data is reported using the ASAP version 4.1 format. This format change will improve data quality by offering more data fields and clarifying certain other data fields. Starting August 1, 2024, dispensation data submissions that do not conform to the requirements of the ASAP version 4.2B format will be rejected by Bamboo Health, the data collection vendor for CURES.

Update: Midwifery Advisory Council

The Medical Board of California (Board) recently welcomed four new members to the Midwifery Advisory Council (MAC): Faith Freeman L.M., Dr. Kenneth James, M.D., Tamara Robertson, Public Member, and Mason Wilson-Tanev, L.M. The MAC currently has one vacant public member position. If you are interested in applying for this position, contact Tonya Morairty at Tonya.Morairty@mbc.ca.gov or go to the Board website for more information. The next MAC meeting is scheduled for May 30, 2024.

Reminder: All licensed midwives should have completed the Licensed Midwife Annual Report (LMAR) for the 2023 reporting year. Completion of the LMAR is required by all licensed midwives in California pursuant to Business and Professions Code section 2516 (c). Please note: a hold will be placed on your renewal if the LMAR has not been submitted.

The Board is seeking experienced licensed midwives to serve as reviewers for the Board. Reviewers play a crucial role in ensuring that licensed midwives practicing in California meet the highest standards of care and adhere to the state's regulations. Reviewers are responsible for evaluating the conduct of licensed midwives and providing recommendations to the Board regarding disciplinary action. You Asked For It, Questions Received from the Web

I need copies of my old medical records, but don't know the name of the physician or where to find them. How can I obtain my records?

If you do not know the name of your previous physician, you should contact the healthcare facility where you received treatment for help locating your records.

If you know your physician's name (but don't know where they currently practice) you may search the Board's website for your physician and send a letter to their address of record to request a copy. Even if the physician is no longer in practice or has passed away, you can still request your records from your physician or through the physician's estate. If you can't locate your physician, the Board suggests contacting your local county medical society or medical insurance company for assistance.

I requested my medical records months ago and still haven't received them from my physician. Does my physician have to provide me with my records?

Yes. As long as you requested your medical records in writing, to be sent directly to you, your physician is required to send you a copy within specified time limits. If you are having difficulty getting your records, you can file a complaint with the Medical Board. Please include a copy of your written request(s). If we can substantiate that the complaint is against a Board licensee, the Board may take action against the physician's license for failing to provide the records within the legal time limit. Please contact the Osteopathic Medical Board of California regarding an osteopathic medical doctor.

What is the penalty if a physician does not respond to my request for a copy of my medical records?

The Board may take enforcement action against the physician for failing to provide you a copy of your medical records when required by law. Options include contacting the physician in an effort to obtain their compliance in providing you a copy of your medical records, issuing a citation and fine, or even taking disciplinary action against the physician's license.

Central Complaint Unit Ad: Medical Consultants Needed

Physician and licensed midwife Medical Consultants review complaints to determine whether a formal investigation by Board investigative staff is needed, or if the complaint can be resolved by a preliminary review of the medical records and a subject's narrative statement.

Participating physicians and licensed midwives are reimbursed $75 per hour for record review and report preparation.

Expert Reviewer Ad: MBC Needs You!

History

The Medical Board of California (Board) established its Expert Reviewer Program in July 1994 as an impartial and professional means to support its investigation and enforcement functions. Expert Reviewers (Experts) assist the Board by providing reviews and opinions on board cases and conducting medical and psychiatric evaluations.

Requirements

Physicians must be board certified, in active practice with 80hrs/month of direct patient care or 40hrs/month if teaching, practicing in their specialty for a minimum of three years after board certification, have no current complaints, no prior discipline, and must be willing and available to testify at an administrative hearing, if necessary.

Midwives

The Board also needs midwife expert reviewers throughout the state of California. Licensed midwives must have an active midwifery practice for the past two years, have no current complaints, no prior discipline, and must be willing and available to testify at an administrative hearing, if necessary.
