In this issue, you will read about some of the new California laws that could affect your practice. For example, AB 3030 provides requirements on the use of Generative AI in medical practices. Additionally, SB 607 requires physicians to discuss the risks of opioid medications prior to prescribing them. You can read about these new laws and many others in the New Law Roundup.

Other highlights from this issue include an update to the Volunteer Physician Registry (VPR) and information for members of the military who are soon being discharged and may qualify for an expedited license in California.

President's Message

The Medical Board is entering an exciting new chapter in our mission to protect consumers and ensure the highest standards of medical care for all Californians.

As part of our commitment to fostering a healthier medical community, we have been exploring ways to support physicians facing substance abuse and other impairing health conditions. Initially, we worked on developing regulations for a health and wellness program aimed at rehabilitation. However, late last year, we received thoughtful feedback from stakeholders and experts who raised valid concerns about the effectiveness of our proposal and its potential unintended consequences.

In response, we revisited our approach with a fresh perspective, guided by national best practices and the insights of leading experts. This led to the development of a draft legislative proposal to create a robust health and wellness program through new state law. On October 24, 2024, we convened a public meeting gather input, and at the Board's meeting on November 21-22, 2024, the Board voted to move forward with the proposal. We are now seeking legislation in 2025 to bring this vision to life.

Why is this initiative so important? Simply put, patients receive the best care from healthy providers. By fostering a culture of wellness in medicine and creating systems that prioritize mental and physical health care for providers, we aim to enhance the quality and safety of healthcare across California. We are excited about the opportunity to prevent harm by addressing substance abuse and other impairing health conditions before they pose risks to patients.. Law Changes Effective January 2025 May Impact Board Licensees' Practice

The Board wants its licensees to be aware of the following new laws that may impact your practice when they take effect on January 1, 2025:

Notifying Patients of the use of Generative Artificial Intelligence (GenAI)

AB 3030 requires any health facility, clinic, or physician's office (including a group practice) to notify their patients when using GenAI to communicate "patient clinical information." The law, however, exempts from this requirement any communication that is read and reviewed by a licensed or certified human health care provider.

Unless the communication is exempt, a notification that the communication was created by GenAI must be provided to the patient, as follows:

  • For written physical and digital communications, like letters or emails, the notification shall appear prominently at the beginning of each communication.
  • For written online communications involving a "chat-based" or other continuous online interaction, the notification shall be prominently displayed throughout the interaction.
  • For audio communications, including voicemails, the notification shall be provided verbally at the beginning and end of the interaction.
  • For video communications, the notification shall be prominently displayed throughout the interaction.

This new law also requires that patients be provided with clear instructions on how to contact a human health care provider, employee, or other appropriate person.

Opioid Medication Risks to be Discussed with Patients

Before prescribing or dispensing the first prescription in a single course of treatment for a controlled substance that contains an opioid, SB 607 generally requires a prescriber to discuss the following with the patient (or a parent/guardian of a minor patient):

  • The risks of addiction and overdose related to the use of opioids.
  • The increased risk of opioid addiction for someone suffering from both mental and substance abuse disorders.
  • The danger of taking an opioid with a benzodiazepine, alcohol, or other central nervous system depressant.
  • Any other information required by law.

Tuberculosis Assessments and Screenings to be Offered to Certain Adult Patients in Primary Care Settings

AB 2132 generally requires a health care provider to offer a tuberculosis risk assessment, and screening (if appropriate) to all adult patients seen in a setting where primary care services are provided to the extent these services are covered by the patient's health care coverage. Providers should follow the latest screening indications recommended by the State Department of Public Health, the federal Centers for Disease Control and Prevention, the American Thoracic Society, or the United States Preventive Services Task Force.

New Laws in 2025

AB 796 (Weber) — Athletic Trainers

Requires a person to meet certain educational and certification criteria before they may call themselves an "athletic trainer" or use similar terms.

AB 977 (Rodriguez) — Emergency Departments: Assault and Battery

Increases potential criminal penalties for someone who commits an assault or a battery against a physician, nurse, or other healthcare worker of a hospital who is providing services within an emergency department.

AB 1842 (Reyes) — Health Care Coverage: Medication-assisted Treatment

Requires a health plan or health insurer to provide coverage without prior authorization or step therapy, or utilization review, for at least one medication approved by the United States Food and Drug Administration (FDA), in certain categories, as specified.

AB 1859 (Alanis) — Coroners: Duties

Authorizes coroners to test deceased persons for xylazine in certain circumstances and requires positive result be reported to the Overdose Detection Mapping Application Program and the California Department of Public Health (CDPH).

AB 1902 (Alanis) — Prescription Drug Labels: Accessibility

Clarifies the existing requirement that dispensers provide translated directions in the languages provided by the Board of Pharmacy to a patient, or their representative, upon their request. Requires pharmacies to provide the person, at no additional cost, an appropriately accessible prescription label, as specified.

AB 1991 (Bonta) — Licensee and Registrant Renewal: National Provider Identifier

Requires licensees and registrants of the Board, and other healing arts licensing boards, to provide their individual National Provider Identifier (if they have one), at the time they renew their license or registration online.

AB 1936 (Cervantes) — Maternal Mental Health Screenings

Requires a health plan or insurer's maternal mental health (MMH) program to include at least one MMH screening during pregnancy, and at least one additional screening during the first six weeks of the postpartum period, and additional postpartum screenings, if determined to be medically necessary and clinically appropriate in the treating provider's judgement.

AB 2018 (Rodriguez) — Controlled Substances: Fenfluramine

Removes fenfluramine from the list of controlled substances.

AB 2099 (Bauer-Kahan) — Crimes: Reproductive Health Services

Authorizes increased criminal penalties related to threats and harm against a reproductive health care services patient or provider.

AB 2115 (Haney) — Controlled Substances: Clinics

Provides specified practitioners new options to dispense a three-day supply of certain narcotics, as specified, including for the purpose of relieving acute withdrawal symptoms or to initiate maintenance or detoxification treatment for someone with an opioid use disorder.

AB 2132 (Low) — Health Care Services: Tuberculosis

Generally, requires an adult patient receiving health care services in certain settings to be offered a tuberculosis screening and testing.

AB 2164 (Berman) — Physicians and Surgeons: Licensure Requirements: Disclosure

Prohibits the Board from requiring an applicant for a physician's and surgeon's license or a postgraduate training license to self-disclose conditions or disorders that do not impair their ability to practice medicine safely.

AB 2270 (Maienschein) — Healing Arts: Continuing Education: Menopausal Mental or Physical Health

Requires the Board, and other licensing boards, to consider requiring licensees to take continuing medical education (CME) in the topic of menopausal mental or physical health.

AB 2319 (Wilson) — California Dignity in Pregnancy and Childbirth Act

Expands the types of health care providers and health facility employees who must participate in implicit bias training related to providing perinatal care. Requires initial basic training on implicit bias to be completed by June 1, 2025, for current health care providers and health facility employees, and within six months of their start date for new health care providers and health facility employees, as specified.

AB 2357 (Bains) — University of California: School of Medicine: University of California Kern County Medical Education Endowment Fund

Establishes the UC Kern County Medical Education Endowment Fund for the purposes of supporting the operating costs associated with establishing a branch campus of an existing UC Medical School in Kern County.

AB 2860 (Garcia) — Licensed Physicians and Dentists from Mexico Programs

Expands and extends the current Licensed Physicians and Dentists from Mexico Pilot Program (LPMPP) into a new program to last for approximately the next 20 years. Updates the relevant licensure requirements and establishes the number of individuals who may hold a current and active license at the same time. Establishes timeframes for when applications may be submitted to the Board.

AB 2864 (Garcia) — Licensed Physicians and Dentists from Mexico Pilot Program: Extension of Licenses

Authorizes eligible physicians licensed under the LPMPP to request a three-year extension of the expiration date of their license. The Board's authority to extend these licenses expired January 1, 2025.

AB 3030 (Calderon) — Health Care Services: Artificial Intelligence

Requires health facilities, clinics, and physicians in solo or group practice that use generative artificial intelligence to create written or verbal patient communications to provide certain disclaimers to their patients.

AB 3119 (Low) — Physicians and Surgeons, Nurse Practitioners, and Physician Assistants: Continuing Medical Education: Infection-associated Chronic Conditions

Requires the Board, and other healing arts boards, to consider requiring licensees to take CME in the topic of infection-associated chronic conditions, including long COVID.

SB 67 (Seyarto) — Health Care Services: Legally Protected Health Care Activities

Requires a coroner or medical examiner to report to the Overdose Detection Mapping Application Program (managed by the Washington/Baltimore High Intensity Drug Tracking Area program) whenever they determine that an overdose contributed to an individual's death.

SB 164 (Committee on Budget and Fiscal Review) — State Government

As is pertains to the Board, requires increasing the Controlled Substance Utilization Review and Evaluation System, or CURES, annual fee from $9 to $15.

SB 607 (Portantino) — Controlled Substances

Requires a prescriber to discuss risks of addiction and dangers related to use, including overdose, with a patient (or their parent if a minor) before dispensing or issuing the first prescription in a single course of treatment for a controlled substance that contains an opioid.

SB 639 (Limón) — Medical Professionals: Course Requirements

Updates CME requirements to encourage physicians to pursue courses on "the special care needs of patients with dementia" by adding that topic to an existing CME requirement for general internists and family physicians with a substantial patient population aged 65 years or older.

SB 908 (Cortese) — Fentanyl: Child Deaths

Requires the CDPH to develop and annually distribute guidance to local health departments, and other stakeholders, to increase awareness of the trends to protect and prevent children from fentanyl exposure.

SB 909 (Umberg) — Steven M. Thompson Physician Corps Loan Repayment Program

Updates this program administered by the Department of Health Care Access and Information additional to provide loan repayment awards to physicians who agree to care for medically underserved populations.

SB 957 (Wiener) — Data Collection: Sexual Orientation, Gender Identity, and Intersex Status

Requires CDPH to collect demographic data, including sexual orientation, gender identity, and variations in sex characteristics/intersex status, from third parties. Requires CDPH to prepare an annual report related to this data.

SB 1120 (Becker) — Health Care Coverage: Utilization Review

Establishes requirements for health plans and insurers related to their use of artificial intelligence for utilization review and utilization management decisions.

SB 1451 (Ashby) — Professions and Vocations

As it pertains to the Board, SB 1451 prohibits a licensing board from charging an application or issuance fee for a temporary license and updates the prohibition on the use of terms like "Dr.," "physician," "M.D.," and related terms used in a health care setting that would lead a reasonable patient to determine that person is a licensed physician. Also, adds an alternative license renewal pathway for those with a physician's and surgeon's license who are still enrolled in a board-approved postgraduate training program but have not yet received credit for 36 months of postgraduate training.

SB 1468 (Ochoa-Bogh) — Healing Arts Boards: Informational and Educational Materials for Prescribers of Narcotics: Federal "Three Day Rule."

Requires the Board, and other healing arts boards, to develop informational and educational materials regarding the federal Drug Enforcement Agency's "Three Day Rule" (see Title 21, CFR Section 1306.07(b)) to help ensure prescriber awareness of existing medication assisted treatment pathways to serve patient with substance use disorders.

SB 1511 (Committee on Health) — Health Omnibus

As it pertains to the Board, requires the CDPH to report repeated noncompliance with fetal death registration timeframes to the Board, Cemetery and Funeral Bureau, or other relevant licensing authority.

Information Systems Branch Update: Volunteer Physician Registry Turns 20 With a New Look!

Launched in 2004, the Volunteer Physician Registry (VPR) has gone through several improvements over the years. The latest improvement is a new design to the VPR which blends with the Board's website template for a seamless transition to the registry. Additionally, physicians will no longer use a separate password to access their account, instead, simply log in via the Interoperability Development Effort to Authenticate Licensees (IDEAL) system. All other functions of the VPR remain the same.

The Board developed the VPR as a way for physicians to give back to their communities by volunteering their services in underserved areas. It is easy for physicians to create and maintain their own profile in the system. These profiles identify each volunteer physician's:

  • area(s) of practice
  • geographic location within California where they are willing practice
  • languages they can speak
  • contact information

Clinics in need of volunteers can search the registry, using the above criteria. The BreEZe database updates the physician's license status information every day. If ineligible to practice medicine, VPR prevents the physician's profile from appearing in the search results.

Enforcement Update: Medical Board of California Reminds Physicians to Check CURES Database

The Medical Board of California (Board) reminds physicians about the requirement to check the Controlled Substance Utilization Review and Evaluation System. ( CURES) before administering, furnishing, ordering, or prescribing a Schedule II-IV controlled substance.

CURES must be checked before the first time a practitioner intends to prescribe, order, administer, or furnish a controlled substance, and has not previously prescribed a controlled substance to the patient, and once every six months thereafter if the prescriber renews the prescription and the substance remains part of the patient's treatment. However, there are several exemptions which allow a physician to prescribe these controlled substances without consulting CURES:

  • When a patient is admitted to licensed clinic, outpatient setting, health facility or county medical facility, or during an emergency transfer to one of those facilities.
  • In the emergency department of a general acute care hospital, and when the controlled substance does not exceed a non-refillable seven-day supply.
  • As part of a patient's treatment for a surgical procedure performed at a licensed clinic, outpatient setting, health facility, county medical facility or place of practice. The controlled substance may not exceed a non-refillable five-day supply.
  • When buprenorphine, or another controlled substance containing buprenorphine, is prescribed, ordered, administered, or furnished while in the emergency department of a general acute care hospital.
  • The patient is receiving hospice care.

Licensing Updates

FSMB's Website Portal Gets an Upgrade!

The Federation of State Medical Boards (FSMB) recently implemented an upgraded website portal featuring a new user-friendly interface.

The upgraded portal improves the efficiency of the application process by consolidating all documents and forms submitted to FSMB by applicants into a centralized location facilitating easier access for reviewers. Additionally, the portal incorporates a timestamp function, which tracks the receipt and processing of documents by board staff, ensuring no submissions are overlooked. This is help streamline licensing and credentialing as it will provide a one-stop-shop in assisting applicants with applying for a medical license.

Previously Licensed Physicians Can Now Apply Online

Applicants previously licensed in California can apply online through the BreEZe system. Previously, these applicants were required to mail paper applications.

Research Psychoanalyst Program to transfer to Board of Psychology

Effective January 1, 2025, the Medical Board of California (Board) will transfer the Research Psychoanalyst program to the Board of Psychology (BOP).

This transition is required by Senate Bill 815 of 2023, which was signed into law last year. This change will not immediately impact the approval or regulation of research psychoanalytic institutions or any individual research psychoanalyst's existing registration or authority to practice.

Starting January 1, 2025, please direct all inquiries relating to the research psychoanalyst program to the BOP at 916-574-7720, toll-free at 866-503-3221, or by email at bopmail@dca.ca.gov.

Updates to Board Forms

The Initial License Renewal Verification of ACGME/RCPSC/CFPC/CODA Postgraduate Training (Form ILR) form was updated to indicate that it can be signed up to 30 days prior to the completion of training required for initial renewal and clarifies the form is exclusively for licensees.

Effective January 1, the Board updated its Certificate of Completion of ACGME/RCPSC/CFPC Postgraduate Training (Form PTA/B) form. The notary and seal sections were removed, language was updated stating the form can only be submitted through the Board's DOCS Portal, and clarifies the form is exclusively for applicants.

Consumer Corner: 2024 Parent and Caregiver Handbook for Sickle Cell Available Online

Caring for a newborn can be both a joy and a challenge. But for those with a child diagnosed with a condition like sickle cell, things can get a lot more complicated. To help those managing this diagnosis, the California Department of Public Health (CDPH) updated its newborn screening program webpage and produced a revised Parent and Caregiver Handbook for Sickle Cell in 2024.

Sickle cell disease is a genetic and chronic condition that affects the body's hemoglobin and red blood cells. The blood cells can clot in the patient's blood vessels, preventing the delivery of oxygen and causing pain or damage to the body. In California, newborns are screened for sickle cell and other diseases. These screenings help doctors identify newborns with an increased risk of having various conditions.

Once your child has been diagnosed, it is important to establish a medical team for your child as soon as possible. The handbook recommends working with experts, such as:

  • A regular health care provider with experience in sickle cell who will provide your child with routine care and is easy to talk to.
  • A hematologist. They're your sickle cell expert who watches for warning signs and works to prevent and manage crises and complications from sickle cell disease.
  • Social workers, therapists, or psychologists who can serve you and your child.

A team of qualified professionals can care for your child and support your whole family as you navigate this diagnosis.

SkillBridge Program: Helping Honorably Discharged Military Members Transition to Civilian Life

If you're one of the many military members ready to be honorably discharged, the Department of Defense's (DOD) SkillBridge program provides information and resources to help with your transition. This transitional course is designed to provide on the job training for military members in their last 150-180 days of service. It's available to American citizens who are officers or enlisted members. According to the DOD, participants will continue to receive their allowances and benefits.

In addition, SkillBridge program participants qualify for expedited review of a license application with the Board. Visit this Board webpage for more information.

You Asked For It, Questions Received from the Web

I am the executor/lawyer/family member of a physician who has passed away. What do I do with all the medical records?

There is no central repository for medical records in California. If the doctor died and did not transfer the practice to someone else, whoever is appointed as the custodian of records can attempt to contact the active patients and offer to provide them with copies of their medical records or offer to transfer the records to the patient's new physician.

I'm opening a medical practice. How can I be sure I'm not violating the corporate practice of medicine law?

Professional medical corporations in California must be owned by one or more physicians licensed in California. Physician licensees must own at least 51% of the shares of professional medical corporations and may not be outnumbered by other types of licensees permitted to own shares in the corporation. See Corporations Code section 13401.5. Lay people and providers not licensed in California are not allowed to own any portion of the practice.

The physician owner(s), or other authorized licensed medical staff must make all the healthcare decisions related to diagnostic testing, making referrals or providing consultations, determining a physician's workload, and the overall care of the patients. No unlicensed persons may make any of the above determinations, as that constitutes the unlicensed practice of medicine.

Additionally, business and management decisions that result in control over the practice may not be made by any unlicensed person. These decisions, such as control over patient medical records, hiring or firing decisions, billing procedures, or selection of medical equipment must be made by a licensed physician.

Additionally, physicians may not practice medicine using a limited liability company or general corporation.

Corporate law can be complicated, and the Board encourages licensees to discuss their medical practices and business enterprises with knowledgeable legal counsel who specialize in this area of practice.

 Warning: Scammers Posing as DEA Agents or Board Enforcement Staff

The Medical Board of California (Board) is aware that scam artists are posing as law enforcement officers, including U.S. Drug Enforcement Administration (DEA) agents or Board staff and calling California physicians as part of an extortion scheme.

Scammers posing as law enforcement may tell victims they have missed a court date as an expert witness and have a warrant for their arrest. Scammers posing as DEA agents may tell victims their license is suspended for illegal drug trafficking and the suspension means they will not be able to practice. The scammers may provide an "Agreement for the Bond and Protocols" that includes statements that licensees are not to share or disclose the investigation to any third party and agree to a bond fee payment of $25,000.00.

The scammers' phone number may show up as the Board's toll-free number, (800) 633-2322, or other Board phone numbers. If posing as law enforcement, they may impersonate actual law enforcement officers using their real names.

Please note, law enforcement officers, DEA agents, and Board staff will never contact physicians by telephone to demand money or any other form of payment. If you receive one of these calls, refuse the demand for payment. Please also consider the following: If the caller is stating they are from the DEA, immediately report the threat using the DEA's Extortion Scam Online Reporting form.

If the caller insists that they speak with you right away, tell them that you'll call them back directly. At this point, some scammers will offer you a phone number as a way to verify they are who they say they are. Do not call the number the scammers provide; instead, send an email with all information about the call to complaint@mbc.ca.gov.

If the phone number of the caller appears to be the Board's toll-free number, it is recommended that you submit an online complaint with the Federal Communications Commission (FCC) using the FCC Consumer Complaint.

If you are a licensee of another DCA Board or Bureau, please contact your respective licensing agency to report a scam phone call.

Central Complaint Unit Ad: Medical Consultants Needed

Physician and licensed midwife Medical Consultants review complaints to determine whether a formal investigation by Board investigative staff is needed, or if the complaint can be resolved by a preliminary review of the medical records and a subject's narrative statement.

Participating physicians and licensed midwives are reimbursed $75 per hour for record review and report preparation.

Expert Reviewer Ad: MBC Needs You!

History

The Medical Board of California (Board) established its Expert Reviewer Program in July 1994 as an impartial and professional means to support its investigation and enforcement functions. Expert Reviewers (Experts) assist the Board by providing reviews and opinions on board cases and conducting medical and psychiatric evaluations.

Requirements

Physicians must be board certified, in active practice with 80hrs/month of direct patient care or 40hrs/month if teaching, practicing in their specialty for a minimum of three years after board certification, have no current complaints, no prior discipline, and must be willing and available to testify at an administrative hearing, if necessary.

Midwives

The Board also needs midwife expert reviewers throughout the state of California. Licensed midwives must have an active midwifery practice for the past two years, have no current complaints, no prior discipline, and must be willing and available to testify at an administrative hearing, if necessary.
